Welcome to SnapExpense. These Terms of Service ("Terms") govern your use of the SnapExpense application and services. By accessing or using SnapExpense, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using SnapExpense, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

2. Service Description

SnapExpense provides:

• Receipt capture and image storage
• AI-powered data extraction from receipt images
• Expense categorization and organization
• Export functionality for tax preparation

3. User Responsibilities

As a user of SnapExpense, you agree to:

• Provide accurate information: You are responsible for ensuring all data you enter or confirm is accurate.
• Verify AI-extracted data: Always review and verify data extracted by our OCR/AI system before using it for any purpose, including tax filings.
• Maintain your own backups: While we store your data securely, you should maintain your own backup copies of important records.
• Comply with applicable laws: You must comply with all applicable tax laws and regulations in your jurisdiction.
• Protect your account: You are responsible for maintaining the security of your account credentials.

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of extracted data
• Uninterrupted or error-free service

We do not warrant that the AI/OCR extraction will be accurate, that tax category suggestions are correct for your situation, or that using our service will result in any particular tax outcome.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPEXPENSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, or data
• Tax penalties, interest, or additional taxes owed
• IRS audits or investigations
• Incorrect tax deductions or filings
• Errors in OCR/AI data extraction
• Damages arising from your reliance on the service

Our maximum aggregate liability for any claims arising from or relating to these Terms or your use of the service shall not exceed the total amount of fees paid by you to SnapExpense in the twelve (12) months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless SnapExpense and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the service
• Your tax filings or tax-related decisions
• Your reliance on extracted or suggested data
• Your violation of these Terms
• Your violation of any applicable laws or regulations

7. Subscription and Payments

Free Tier: Limited to 10 receipts per month with basic features.

Pro Tier ($6/month): Unlimited receipts, CSV export, and all tax categories.

Pro+ Tier ($12/month): All Pro features plus quarterly estimates, bank import, and priority support.

Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

8. Cancellation and Refunds

30-Day Money-Back Guarantee: If you are not satisfied with your paid subscription, you may request a full refund within 30 days of your initial purchase. To request a refund, contact us at support@snapexpense.com.

You may cancel your subscription at any time. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will retain access to export your data for 30 days after cancellation
• After the 30-day money-back period, refunds are not provided for partial months

9. Data and Privacy

Your use of SnapExpense is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Termination

We may terminate or suspend your account and access to the service at our sole discretion, without prior notice or liability, for any reason, including but not limited to violation of these Terms.

Upon termination, your right to use the service will immediately cease. You may export your data for 30 days following termination.

11. Dispute Resolution and Arbitration

Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Small Claims Exception: Either party may bring an individual action in small claims court if the claim qualifies.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the service. Your continued use of the service after such modifications constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SnapExpense regarding your use of the service.
